One of the characteristics that made Islam an eternal, living and valid Sharia is that it is a realistic Sharia that does not deviate from people's reality in all that it permits and prohibits. It takes into account people's circumstances and conditions. Hence, the state of hardship and the general affliction becomes clear as a reason for mitigation and an excuse for which sometimes forbidden acts are committed and obligatory duties are neglected. It is within this framework that the subject of this thesis falls, a subject that combines jurisprudence and its principles.
