dc.description.abstractThis study is composed of three titles and each title has several parts. This study describes briefly the meaning of hudud and crime and explains the verse concerning the Hadd punishment for Hirabah. This study consists of view of the four Mazhab and comparison between Syariah Penal Code Order 2013 Brunei Darussalam and Islamic Jurisprudence. As for punishment, according to the four Mazhab, divided into four penalties, namely execution, crucified, amputation, and banishment according to what happens when Hirabah happened. While in Syariah Penal Code Order 2013, there was no crucifying and banishment. These penalties are implemented to keep religion, life, intellect, property and lineage. Also included in this study is the translation of the Order of the Syariah Penal Code in 2013 related to Hirabah.en_US
