Abstract

Islamic witness plays a very crucial part in a process of judgement especially in the Hudud cases. With that, a person can be convicted guilty or not. The thesis consists of the introduction to the witness and hudud in Islamic Law perspective as well as in Brunei Islamic Evidence Law. This thesis also explain about the witness judgement in Hudud in Islamic Fiqh perspective and also elaborate the witness condition in specific and in general. Apart from that, the thesis is also based on the witness law in Islamic Evidence Law including the use of it in Brunei Shariah Court. References used in this thesis are turath kitab as well as the contemporary books and also based on the Brunei Law. The purpose of choosing this topic is to gain knowledge about the law that is linked with the witness in Hudud in Islamic Fiqh and in Brunei Evidence Law.
