Abstract

This research aims to identify one of the issues in the field of Islamic jurisprudence that is the issue of the discrepancies between the texts of Quran and Sunnah in the context of preferences of those texts and the circumstances related to that topic. The researcher follows the inductive and analytical method in terms of definitions, rulings, issues, etc., which are related to this subject. This topic is surely amongst the higher levels of subjects in context to the study of Islamic jurisprudence as it is the main target for learning this field. The research begins with the first introduction to the topic by giving a rough picture of the possibility of discrepancy between the texts of the Syari’ah and engaging some related issues. Then the research evolves into the second introduction for the topic revolving around the ways of the scholars of Islam in solving those so-called discrepancies, with a rough explanation for every solutions mentioned. Finally, the research then starts to engage the main issue which is the actual Murajjihat mentioned by famous scholars of the Syafie school in making preferences between those texts that overrule each other.
