Abstract

The purpose of this research is basically to evaluate the Form (Offer and acceptance) in Islamic Jurispudence and civil law of Brunei. Among the specific objectives of this research is to know what are the form (offer and acceptance) for the products that were offered by Bank Islam Brunei Darussalam. The conditions of valid form in Fiqh Islam, either in marriages or transactions. As well as to know about the provided contract laws in Brunei Darussalam. This paper focus mostly in finding the opinions from Bank Islam Brunei Darussalam,Majistrate Court and Syariah Court, Marriage, Divorce, Void and Muslim’s Ruju’ division. To obtain these informations, interviews were made with all these three parties. From the interviews, I have obtained various information where the Bank Islam Brunei Darussalam and Syariah Court, Marriage, Divorce, Void and Muslim’s Ruju’ division said that the form were made according to syara’.
