Abstract

In this academic writting, the writer will explain about hudud zina in Islamic Syariah Law and in Syariah Penal Code Of Brunei. The writer will also explain about the problems that is associated with zina penalties in Islamic Syariah Law and the differences of opinion from the well-known muslim scholars. The main objective of this academic exercise is to teach all muslims generally and local Bruneian people specifically on zina penalties according to Islam and also to add and expand the knowledge of zina penalties in both Islamic syariah law and Syariah Penal Code Of Brunei and also to help the researchers to do their research about it. To achieve such aim and objectives, this academic exercise will use books of Fiqh and others for references, as well as references from the internet. This academic exercise consists of two main chapters. In the first chapter , the writer will explain about the meaning of zina from the Islamic point of view and its pillar, and the text that contain about zina from the holy Quran, Sunnah and Ijma’, the wisdom behind its proscription and the meaning of zina from the Syariah Penal Code of Brunei. While in the second chapter, it is about the punishment of zina, how to proof the zina and on how to conduct the whipping and the stoning in accordance to Syariah and the punishment of zina in Syariah Penal Code of Brunei Darussalam. Hopefully this academic research can be used as reference and guidance for high institutions and schools in Brunei Darussalam.
