Abstract

A Rebellious wife or Recalcitrance Wife means that the wife is usually associated with refusal to obey her husband. However, the word nusyuz not focused on women only, but her husband was not immune from the label of Nusyuz if he does not fulfill the rights and responsibilities as a husband. The author has divided this thesis into 5 chapters. First chapter, it’s about the introduction of this topic such as definitions, evidences, and verdicts. Second Chapter, It does discuss about the basis of Disobedient Wife, Such as the early sign of Disobedient and the cause of it. Third Chapter gives information about overcoming the rebellious wife with advices, sleeping apart and non aggressive pound. Then, if it continues for a length of time, The Judge can send 2”hakam” to improve their relationships or to split from each other’s if it’s the best thing to do. The fourth Chapter discuss about the effects of a disobedient wife in living, expenses, Shares and I’la. The fifth Chapter or last chapter is about the disobedient wife in the Brunei’s Islamic family law, here the author give details about the history of Brunei and its law, sample case of disobedient wife and punishments.
