Abstract
This research aims to identify and study the differences in engagement from Brunei Darussalam Custom and Islamic jurisprudence. As we know, engagement is a custom or sharia that is always practiced in the Malay community, do the community practice Malay customs mostly in line with Islamic jurisprudence or many conflicting. The researcher conducted this study by referring to past and contemporary fiqh books related to the subject of Fiqh Munakahat in engagement and any book related to the title of the study to distinguish between Islamic fiqh and custom in the country of Brunei Darussalam, especially engagement .Therefore, this research aims to study courtship from the perspective of Islamic law and customs in Brunei Darussalam. In this study, the researcher uses a descriptive approach in the first chapter, where he explains about courting in Islamic law, and in the second chapter, explains about courting in the customs of Brunei Darussalam. This research also uses an analytical approach, which analyzes the differences between Islamic law and customs in Brunei Darussalam. Customs in the country of Brunei Darussalam do not conflict with religious teachings, they can be followed as long as they do not harm the individual family or other people. Therefore, every couple should look carefully at the positive and negative aspects of practicing Islamic engagement customs.
