Abstract

This study aims to investigate the adoption of illegitimate children from the Islamic Legal Perspectives and Brunei Law. The content analysis method of legal documents is used to achieve the objectives of this study; which is a comparative analysis between Syariah law and Brunei law in the adoption of illegitimate children. The results of this study show that the application of the laws of Brunei Darussalam is based on Shafi'i school of Islamic Syariah where these two laws have more similarities than differences. This study is expected to be a source of legal reference and clear procedures in dealing with the issue in the future.
