Abstract
This study will discuss on the issues relating to wife’s contribution in household maintenance, focusing on her contribution in wife’s maintenance expenses that are obligatory on the husband, starting with the explanation on wife’s maintenance that is obligated towards the husband, and regarding her contribution in household maintenance and the factor that leads to her contribution, and lastly regarding the issues that arise from her contribution that happened in Brunei Darussalam. The researcher has chosen to write about this topic because the issues in this topic are widespread throughout the world, and the researcher thinks that most married couples did not handle this matter thoughtfully, hence this topic has been chosen to make clear of the confusions and spread knowledges regarding this matter in a simple and understandable form. Among the objectives of this study are to understand the wife’s maintenance towards her husband according to Islamic jurisprudence and regarding her contribution in household maintenance as well as the factors that lead to her contribution, and to explain the issues arose from it. The researcher has written this study around these objectives based on the opinions of Ahli Sunnah Waljamaah’s jurists and Islamic Family Law in Brunei Darussalam as well as several cases relating to this topic. The study was written by referring to Islamic sources, jurisprudence books, Islamic Family Law Chapter 217, as well as a research conducted at Brunei’s Syariah Court on related cases and also an online survey regarding the opinion of Brunei community on this topic. This study has concluded that the wife’s maintenance that is obligated on the husband are food, clothing, a home, hygiene tools, helper if the wife needs it, household furniture and beauty needs if the husband wants his wife to beautify herself, and the obligations are measured by sufficiency. The wife’s contribution to the maintenances is recommended, and the wife can claim in the court the arrears of her maintenance that has become a debt on the husband, as stated in Brunei Law.
