Abstract
This thesis examines the concept of child testimony in both Islamic jurisprudence and Bruneian law, a topic of significant interest due to its implications for justice and legal enforcement in societies governed by legal systems based on Islamic principles. The research aims to understand and analyze the notion of child testimony and its application within the contexts of Islamic jurisprudence and Bruneian law. This is achieved through studying the foundational principles and legal provisions related to this topic, along with analyzing scholarly opinions, judicial precedents, and legal practices within both Islamic jurisprudence and Bruneian law. By analyzing these data and information, light is shed on the challenges and developments in assessing the testimony of minors and their role in judicial proceedings and governance in societies applying laws derived from Islamic principles, while also highlighting the cultural and social factors influencing this context. Providing a deeper understanding of this complex issue may contribute to the development of legislation and policies governing juvenile courts and the delivery of justice more inclusively and effectively in both Islamic and Bruneian societies.
