Abstract
Women who are menstruating or in postpartum confinement are prohibited from entering mosques. However, it is possible that some members of the Bruneian society may disregard or be unaware of this prohibition. Hence, the question arises: Is the understanding and practice of the Bruneian society and the management system of the mosque in line with the Fatwa of the state mufti, Irshad Hukum and the Shafi'i school of jurisprudence? Therefore, the objective of this study is to demonstrate the compatibility of the implementation of mosque regulations related to menstruating and postpartum women among the community with the Shafi'i school of jurisprudence, the state Mufti’s Fatwa, Irshad Hukum and the management of the mosque. The researcher employed two methods in this study: descriptive and analytical. Through the descriptive method, the researcher collected information from relevant direct and indirect sources and references, such as fiqh literatures, particularly those of the Shafi'i school of jurisprudence. The researcher also gathered information through interviews with five imams selected from the Brunei-Muara district. Meanwhile, through the analytical method, the researcher collected data through a questionnaire consisting of eleven questions related to the reality of the mosque and its regulations. Among the findings of the study is the compatibility of mosque management with the Shafi'i school of jurisprudence, the state Mufti’s Fatwa, Irshad Hukum in implementing the mosque regulations related to menstruating and postpartum women. However, the understanding and practices of the community, in part, do not align with the Shafi'i school of jurisprudence, the state Mufti’s Fatwa, Irshad Hukum and the mosque management, as explained by the selected mosque imams. This particularly applies to issues related to areas prohibited for menstruating or postpartum women within the mosque.
