القتل بسحر وأحكامه في الفقه الإسلامي والقانون البروناي

Abstract

Magic has become a frequent topic that threatens the Muslim community for years. The community has a responsibility to face this issue in any way possible. Media, advertising, writing, and preaching are some ways to address this problem. Magic practices are widespread in communities that are not firm in their religious beliefs, practices, ignore the serious effects that magic has on their religion, minds, and bodies. They are driven toward this path of evil by the hatred and envy they have towards others and their feelings of vengeance. They cannot rest until they see others suffering, being attacked by illness, separated from their partners, or even killed. In Islamic jurisprudence, the laws relating to magic, its types, and the evidence indicating the existence of magic and other related matters have also been explained. Killing using magic is a very heinous and bad act in the sight of Allah Subhanahu Wa Ta’ala. Therefore, this discussion will explain in more depth the laws of killing using magic from the perspective of Islamic Fiqh and the punishment and acceptance of it from the perspective of Brunei's law. Therefore, the objective of this research is to gain a deeper understanding about murder, magic, and the law of murdering with magic from the perspective of Islam and the laws of Brunei Darussalam. To achieve this objective, this study uses a library research method, which involves referring to primary and secondary sources, such as Fiqh books and others. The conclusion of this study is that the law of murdering with magic is provided for in Brunei Darussalam to safeguard the welfare of the community. With the permission of Allah, may we all gain additional knowledge from it and be able to help us in addressing all the issues and problems that arise regarding this issue.
