Abstract
In the modern world, smoking is a new problem. Certainly, there was no such thing as a smoking ban in the Quran or Hadith during the time of Prophet Muhammad Shalallahu 'Alaihi Wasallam, nor was there a reference to cigarettes or smoking during that time. Islamic law, however, can be created based on norms, situations, and the compatibility of contemporary living changes. In Brunei Darussalam, smoking is likewise prohibited and subject to legal consequences. As a result, this research will go over the opinions of both past and present scholars about smoking's legal status under Islamic Shari'ah. It will also explain how smoking in Brunei Darussalam is considered a crime, along with outlining the associated penalties and fines. This study's goal is to learn about the range of smoking regulations that have been developed and researched by past and present scholars, as well as their perspectives on an issue for which there is no legal precedent in the Quran or Hadith. This research delves into the explanation of the Government Mufti's decision, which forbids smoking. His Majesty the Sultan has backed this decree by passing the Tobacco Order, 2005, a statute that addresses cigarettes and smoking. Even now, the legislation is still in effect. This study makes full use of qualitative and library research methods, which entail examining and compiling data from prior studies using a variety of resources, including books, historical accounts, and articles about smoking laws. The results of this study will increase awareness of smoking's negative effects on one's health and the health of others around them among the Muslim community as a whole and the broader public in particular.
