Abstract

This marriage is an alliance ceremony performed by two individuals or officializing their marriage bond to establish a legal relationship according to the law that has been directed by civil or shariah law. In marriage, there are also many problems that arise such as underage marriage. Half of the countries still allow this underage marriage including Brunei Darussalam. In this discussion, we will discuss about underage marriage in Islam and the law in Brunei Darussalam. This study will also discuss the meaning of marriage in Islam, the understanding of the scholars and the shariah and civil law about underage marriage. This study will also analyze underage marriage from two laws in Brunei Darussalam, namely, Shariah and civil law. The method used in this study refers to the books of jurists and other scholars, in addition to that, in this study, interviews were also conducted. In addition, we should understand the reason why this underage marriage is implemented in Brunei Darussalam and the age limit for marriage.
