Abstract

Islamiyyah Sharia law never neglects the human welfare in life. Because nowadays the financial system is more efficient and growing vigorously, the implementation of the financial system nowadays is more about simplifying a person's affairs. An important objective for the title of this study is to explain in more detail the laws regarding guarantee with payment of wages in terms of Shariah and the application of this procedure in the life of society today. With that, this study examines the law of guarantee implementation according to syariah law and its implementation in the present with wage payment, it also discusses the forms of guarantees, their effects and brings arguments related to guarantees. The method used in this study is to examine the views of the people of Brunei Darussalam with issues related to guarantees with wage payments. The conclusion from the findings of this study is that there is a contradiction between the guarantee with the payment of wages among the jurisprudence scholars in which some conditions are not allowed because of the elements that lead to something that is forbidden in Islam and there are some conditions that allow the guarantee with the payment of wages with certain conditions.
