Abstract
Brunei Darussalam has had and used Shariah law since before the arrival of the British. However, it became stronger after Sultan Haji Hassanal Bolkiah Mu’izzaddin Waddaulah declared and enforced the Syariah Criminal Offences Enactment of Brunei Darussalam on October 22, 2013, which was then followed by three phases. The first phase was on May 1st, 2014, followed by the second and third phases on April 3rd, 2019. This shows that the implementation of laws in Brunei Darussalam is fair and strong in order to safeguard the wellbeing of its society and people. This does not mean that Brunei Darussalam relies solely on one law, as civil law is also still in use. This study aims to provide an understanding to the people of Brunei about the laws currently being used. Therefore, this study explains the meaning of laws, the differences between civil law and Shariah law, discusses the history of laws in Brunei Darussalam before and after the arrival of the British, as well as the current courts and their jurisdictions, and most importantly, the Syariah Criminal Offences Enactment of 2013.
