Abstract
Criminal offenses in Islam are an issue that needs to be carefully studied. This is because it is not only done by normal people but can also involve people with disabilities (OKU) and the community. Criminal jurisprudence provides appropriate punishment for the perpetrators of crimes so that justice can be upheld without compromise. It is important as a reward for wrongdoing and a lesson to others. The implementation of Islamic criminal punishment is also very important in order to safeguard the five basic principles of Sharia, namely religion, life, reason, lineage and wealth. However, the punishment carried out must be appropriate to the situation and condition of the offender, in addition to taking into account a conducive environment. Although the criminal offense of OKU has been widely discussed according to civil law, it has received less attention in the discussion of Islamic law. Therefore, this article will try to identify criminal jurisprudence issues related to the disabled. The writing methodology used in this scientific exercise is to read and refer to the Al-Quran and the Sunnah of the Prophet, and to fiqh books and other related books in the library or the internet.
