Abstract
World history has proven that the position of women is lower than men. During the Jahiliyyah era, women did not receive inheritance rights at all, instead they were also inherited as objects. In Europe, women finally realized and rebelled and then fought for their rights to be equal to men. Likewise, when Islam came, women finally got the inheritance even though it was not the same as men. This is what causes gender activists and feminists to challenge justice and equality in the distribution of unequal inheritance. This study aims to determine the concept of justice and gender equality and translate the Islamic heritage law into the concept of gender equality and justice which is believed to be the welfare of the general public and women in particular. The results of this study can be concluded that the theory of Islamic heritage law which seems to be gender biased and gender injustice is considered to be in harmony with this concept.
