Abstract

This study highlights the issue of apostasy. The issue of apostasy is becoming more prevalent as if apostasy is not a crime under Islamic law. Furthermore, knowledge and instances of apostasy are easily gained through social media. The objective of this study is to explain the facts of apostate crime in Islamic sharia and explain the reasons for the occurrence of apostasy in general as well as its punishment from the perspective point of view of fiqh through four Mazhab. In addition, there is also a description on the execution of the irtidad sentence in Brunei Darussalam through the laws that have been enacted. The results of this study found that based on descriptive methods obtained through various references to books, articles or reading materials online, that apostasy is included in the criminal section in the scope of fiqh by bringing a detailed explanation. In addition, studies have shown that the causes of apostasy are made up of various aspects both individually and in society. The law of Brunei also states about this crime although the scope of Brunei's law is limited from its practice. Despite the sharia law and criminal knowledge in fiqh regarding the punishment of apostasy, it brings an execution to protect the faith of the Muslim community in general and the population of Brunei especially the official religion of the country is Islam.
