أحكام الميراث في الفقه الإسلامي ومدى فهم المجتمع عنها في سلطنة بروناي

Abstract

The problem contained in this research is about the lack of knowledge and understanding of the society about the Islamic Inheritance in Brunei Darussalam. As well as the difficulty in obtaining a reference material that includes the entire matters that associated with it. Therefore, the researcher will be discussing on the laws of Inheritance in Islamic law other than faraidh in order to be a reference to the people of Brunei Darussalam. Furthermore, this research also aims to increase knowledge for those who don’t know or don’t understand about the Inheritance in Islamic law. The methodology used in this research includes, the inductive and descriptive method in which information on the topic is gathered through various books written by Shafi'i scholars and any other Islamic books that are related to this subject, as well as supporting them with verses from The Quran and Sunnah of the Prophet. The other method is field research which is done by conducting a questionnaire, to measure the level of understanding on the topic of research among the Bruneian muslims. Moreover, this field research is also to know the reason for the lack of knowledge and understanding of the Bruneian muslims about it. And at the end of this research, the researcher also states the effects that may occur if this problem is not contained that will cause more harm within the family.
