Abstract
The problem of this study is the lack of public knowledge in the Bruneian society on the “Permissibility of Possessing a Prohibited Degree On The Basis Of Necessity” and its application in Fatwa of Brunei Darussalam, which is very important as it seeks to safeguard the welfare of persons in distress and aims to facilitate them. The study aims to explain the meaning of “Permissibility of Possessing a Prohibited Degree On The Basis Of Necessity” and to know its application in Fatwa of Brunei Darussalam. The methodology of this study was developed using inductive and comparative. The inductive method is to extrapolate information, reference books and magazines related to this title either from Arabic, English or Malay, and these sources will be combined and translated into Arabic. It's a comparison method that makes comparisons of some of the problems associated with this method and expressing a "rajih" opinion on every problem. This study covers three parts: the general context of the “Qawaid Fiqhiyyah”, the general context of “Permissibility of Possessing a Prohibited Degree On The Basis Of Necessity”, the general context of fatwa Brunei Darussalam. At the end of the research there were some important decisions: the “Permissibility of Possessing a Prohibited Degree On The Basis Of Necessity” approach is to take care of the need for those in distress provided it does not exceed the prescribed limits, and as Brunei Darussalam is based on the “Mazhab” Shafi'i, Brunei Darussalam therefore uses the “Mazhab” Shafi'i in devising the fatwa, but that does not mean that Brunei leaves the other sects of “Mazhab Ahli Sunnah Wa-Jama’ah”.
