Abstract

This academic writing is needed to complete graduation requirements to obtain a bachelor’s degree at the Sultan Sharif Ali Islamic University, Brunei Darussalam. With Allah guidance, researcher has selected Qadhi’s Sentencing Through His Knowledge: Studies in Islamic Jurisprudence and Law of Brunei as his topic. This writing focus on how adjudication that referred to as the knowledge of a qadhi, or a judge. The scope of this writing is focused on the standard methods of conviction from the Islamic perspective, by looking at the discussion between scholars, and to know whether this method of proof is applicable or not. Also to know from Brunei laws point of view and to see how far the implementation of this method used both in Syariah and Civil Courts. This writing consists of three main chapters preceded by an introduction and ended with a conclusion and a bibliography. In the first chapter, researcher will explain the definition of judgment and its importance. In the second chapter, it is about the judgment through the qadhi’s knowledge from an Islamic point of view. Then, in the final chapter, will be discussing about the use or the application of this method in Brunei Darussalam within the Syariah and Civil Courts. Vital results and some of appendices which related to the topic will be concluded at the end of the writing.
